It offers income tax exemptions, under CIT or PIT, for up to 15 years in exchange for carrying out a new investment. The program covers different industries and scales of activity, from microbusinesses to large companies. Below are the conditions, criteria and step-by-step procedure described in this guide.

Who is the PSI program for?

The PSI program is intended for companies planning new investments, such as building new production facilities, service centers or research and development centers. It supports both projects built from scratch and the expansion of existing facilities. The program covers all company sizes, while small and medium-sized enterprises may benefit from preferential terms, including lower minimum investment values that depend on company size and region.

Preferred sectors

Although PSI covers a broad range of industries, priority is given to investments in areas such as:

Modern technology and innovation, for example pharmaceuticals, biotechnology and medical-device manufacturing.

Automotive and aviation, for example the production of automotive parts and aircraft engines.

ICT, for example software development, cybersecurity and telecommunications infrastructure.

Business services, for example BPO/SSC and R&D centers.

Industries excluded from the program

Some industries cannot use PSI, including businesses involved in manufacturing:

explosives,

alcohol,

tobacco products,

steel,

and businesses operating in energy, wholesale or retail trade, construction, accommodation, food services and gambling.

Benefits of participating in PSI

Income tax exemption (CIT or PIT)

Businesses may receive relief from income tax for up to 15 years. The amount of the exemption depends on the company’s size and the investment location. The less economically developed the region, the greater the support, ranging from 10% to 50% of the investment value.

Duration of support

The PSI program offers support for 10 to 15 years, allowing businesses to plan long-term development with the support of tax exemptions.

Program flexibility

The program is available to a broad range of businesses, including small and medium-sized companies and companies in innovative industries.

Step-by-step guide: how to obtain PSI support

Step 1: Check whether you qualify for PSI

First, determine whether your business meets the PSI criteria in terms of company size, investment value and other requirements.

Company size

PSI is available to businesses of different sizes, and company size affects the minimum investment value:

Micro-enterprises: employ up to 10 people and have turnover or a balance-sheet total not exceeding EUR 2 million.

Small enterprises: employ up to 50 people, and turnover or balance-sheet total must not exceed EUR 10 million.

Medium-sized enterprises: employ up to 250 people, have turnover up to EUR 50 million or a balance-sheet total up to EUR 43 million.

Large enterprises: exceed the above employee, turnover or balance-sheet figures.

The investment value and number of jobs the company plans to create will vary depending on its enterprise category.

Entities eligible for a tax exemption

CIT

Under the Corporate Income Tax Act, entities that may benefit from the relief include legal persons, companies in formation and other organizational units without legal personality, subject to certain exceptions:

Legal persons, such as joint-stock companies, cooperatives, foundations and associations with legal personality,

Companies in formation, such as a limited liability company in formation or a joint-stock company in formation,

Organizational units without legal personality, except for inherited enterprises and certain partnerships without legal personality, for example registered partnerships and professional partnerships,

Limited joint-stock partnerships with a registered office or management in Poland,

CIT taxpayers who are partners in a partnership without legal personality, for example a joint-stock company that is a partner in a limited partnership.

PIT

Under the Personal Income Tax Act, the following may also qualify for the relief:

Individuals conducting business activity,

Partners in civil-law partnerships, registered partnerships, professional partnerships and limited partnerships whose income is taxed under the general rules or at the 19% flat rate.

Type of investment

PSI supports five main types of investment:

Establishing a new facility

A new investment involving the establishment of a business or facility means creating an independent entity separated from the taxpayer’s other activities. To qualify as new, the business or facility must be independent and operate separately from the taxpayer’s other business activities. Creating a new business must not be confused with optimization measures that unjustifiably move assets from another part of the taxpayer’s activity to create the appearance of this type of investment.

Increasing the production capacity of an existing facility

An existing facility may receive support to expand its production capacity. However, purchasing a single machine or device qualifies only if it significantly increases production efficiency.

Example: If a company buys a new machine or welding robot that makes it possible to increase the number of products manufactured, this increases production capacity. By contrast, buying a machine that only replaces existing equipment, without increasing output, does not qualify as a development investment.

Diversifying production

Diversification means introducing new products that the facility did not previously manufacture. This requires investment in new fixed assets or technologies that enable production of new products or significant modernization of existing production lines.

Example: Before the project, a company manufactured only solar collectors. After the project, it also begins producing automation systems for solar installations. Introducing a new product type into production is an example of diversification.

Changing the production process

Eligible investments introduce changes to a facility’s production technology that increase efficiency. One example is moving from a manual to an automated production line.

Example: A production-process change may occur when a company previously manufactured solar collectors on a manual production line and automates the entire production process after completing the project.

Acquiring the assets of a closed facility

Acquiring the assets of a facility at risk of liquidation may qualify as a new investment, provided that the purchasing business is independent of the seller. The acquisition covers only the facility’s tangible assets and does not include the acquisition of shares or ownership interests.

Step 2: Assess the minimum investment value

The investment value from which you can seek support depends on company size and the location of the planned investment. Lower minimums apply to micro and small enterprises, and higher ones to medium-sized and large businesses. The thresholds also vary by region. Requirements are lower in less developed areas to encourage investment there.

Micro and small enterprises: the minimum investment in less developed regions is usually PLN 200,000, but it may be higher in more developed regions.

Medium-sized enterprises: the minimum investment is PLN 500,000.

Large enterprises: must invest amounts ranging from PLN 10 million to PLN 100 million, depending on the region.

Where to find more information about minimum PSI investment outlays

On 25 September 2024, new minimum investment outlay thresholds were introduced for businesses seeking a tax exemption under PSI. These rules, based on the announcement of the President of Statistics Poland on average unemployment rates and the Council of Ministers’ regulation on public aid granted to certain businesses for new investments, applied until September 2025. Check the currently applicable thresholds directly with the managers of the Special Economic Zones or on the relevant institutions’ websites, because minimum investment outlays are updated periodically using Statistics Poland data.

Minimum investment outlays in PSI

Step 3: Check the investment location

PSI offers different support terms depending on the region, to promote development in less developed areas.

Support intensity by region

Less developed regions, such as Eastern Poland: exemptions may reach up to 70% of the investment value.

More developed regions, such as the Mazowieckie Voivodeship: support is lower, ranging from 10% to 35%.

Tax exemption period

The investment location also determines the length of the tax exemption period:

15 years in less developed regions, such as Eastern Poland,

12 years in regions with an average level of development,

10 years for investments located in the most developed regions, such as the Mazowieckie Voivodeship.

Relief amount by location and company size

Voivodeships with a low level of economic development: relief may be up to 70% for small businesses, 60% for medium-sized businesses and 50% for large businesses.

More developed regions: in the Mazowieckie Voivodeship, particularly Warsaw, and in the Dolnośląskie Voivodeship, relief ranges from 10% to 35% of eligible costs.

Conditions for using the tax exemption

To use the relief, a business must maintain the new investment and fixed assets for at least:

3 years for small and medium-sized enterprises,

5 years for large enterprises.

Example: If a medium-sized enterprise plans an investment worth PLN 15 million in a region where the relief is 50%, and eligible costs include purchasing machinery and modernizing an existing facility, it may receive PLN 7.5 million in tax exemption, or 50% of PLN 15 million.

Step 4: Assess whether your investment meets the qualitative criteria

The more technologically advanced and innovative the investment, the greater the chance of obtaining support.

A detailed description of the PSI qualitative criteria is available in two documents:

Council of Ministers’ Regulation of 28 August 2018 on public aid granted to certain businesses for new investments: it specifies qualitative and quantitative criteria that investments must meet to qualify for the PSI tax relief. Detailed qualitative criteria

Act of 10 May 2018 on Supporting New Investments: it establishes the general rules for granting support, defining the types of investments covered and the powers of entities such as the Ministry of Development and Technology and Special Economic Zone managers to issue support decisions.

Websites of Special Economic Zone managers, such as the Katowice Special Economic Zone or the Krakow Technology Park, provide supplementary documents and detailed guidance on qualitative requirements and application procedures.

Step 5: Identify eligible costs

PSI support covers only so-called eligible costs, meaning expenses that may be included when calculating the tax exemption. They include:

Purchasing fixed assets, such as machinery, buildings or land used in the project.

Building or modernizing infrastructure, including costs of expanding or modernizing production facilities.

Acquiring technology, including licenses, patents and specialist software.

Costs of hiring new employees, such as their remuneration for a specified period.

The right to an income tax exemption on income from a new investment depends on incurring eligible costs.

Catalogue of eligible costs under Section 8 of the WNI regulation

Eligible costs include costs of:

acquiring land or the right of perpetual usufruct,

acquiring or self-producing fixed assets,

expanding or modernizing existing fixed assets,

acquiring intangible assets and legal rights as part of a technology transfer, including patents, licenses, know-how and unpatented technical knowledge,

leasing or renting land, buildings and structures,

acquiring assets other than land, buildings and structures through a finance lease.

More about eligible costs is available in the 2020 tax explanations.

Step 6: Apply for a support decision

If you meet the criteria and have a clearly defined investment plan, prepare the documents needed to apply to the appropriate Special Economic Zone (SEZ).

An application may be submitted, among other places, to the management board of an SEZ. The Krakow Technology Park, for example, provides application form templates and attachments.

Basic documents

Investment business plan: a detailed description of the project, including market analysis and a financial plan.

Financial statements: financial documentation for the last 3 years. For new businesses, a financial declaration is provided.

Forms and attachments: a list of investment costs, planned employment and evidence that qualitative criteria are met.

Additional documents

In addition to the basic documents, the following may be required:

Extract from the National Court Register (KRS) or entry in the Central Register and Information on Economic Activity (CEIDG): confirms the company’s legal form and registration details.

Articles or partnership agreement if the investment is carried out by a company, to confirm its ownership structure and business activities.

List of eligible expenses: a summary of costs included in the support calculation, such as machinery, equipment, land, construction and infrastructure modernization.

Price offers and cost estimates for planned purchases or investment services, if available, to support the estimated costs.

Documents confirming own contribution

Bank certificates confirming funds or loans allocated to the investment.

Declarations of support from investment partners or financial institutions if funding comes from more than one source.

Analysis of the impact on the local market and environment

An environmental report or environmental impact assessment if the investment requires environmental approvals.

An analysis of the labor market and the investment’s regional impact if the investment involves a larger number of employees.

Evidence that qualitative criteria are met

Documents describing technologies and solutions used in the investment if the project involves innovative technologies.

Cooperation agreements with scientific and research institutions if the investment involves cooperation with universities or research centers, such as relevant agreements or letters of intent.

A human resources management plan confirming readiness to hire local employees and provide training and skills development.

Opinions, approvals and administrative certificates

Administrative decisions related to the investment, such as building permits or filings with local authorities, if the project requires approvals before work begins.

Certificates confirming there are no outstanding tax or social security contribution arrears, from the tax office and the Social Insurance Institution (ZUS), confirming the business’s financial reliability.

Additional attachments and power of attorney

Energy-efficiency documentation or a waste management plan, especially if the investment meets sustainability-related criteria.

A power of attorney if the application is submitted by the business’s representative.

The support decision is formally issued by the Minister of Development and Technology, but the SEZ manager assesses the application and conducts the process.

Step 7: Implement the investment

After receiving the support decision, you can begin implementing the investment. The public aid is available for 10 to 15 years, depending on the location.

Important: Starting the investment, for example construction or purchasing machinery, before obtaining the decision excludes the possibility of receiving support. Aid is available only for new investments that had not started when the application was submitted.

Step 8: Inspection and settlement of the investment

After completing the investment, the company must submit appropriate reports and settle eligible costs on which the tax exemption is based.

Other questions

How long do the formalities take?

Formalities for obtaining PSI support usually take from 1 to 3 months, but may vary depending on the complexity of the investment and the time needed to collect documents. Timing also depends on the region and the local SEZ with which you work.

After an application is submitted, the support decision must be issued without undue delay, although the law does not set a precise fixed timeframe. Also allow time for consultations and amendments that may arise during the assessment.

What do inspections and audits of PSI investments and settlements involve?

PSI inspections and audits monitor whether projects comply with the support decision and public aid rules. As a business using the relief, you must carry out the project in accordance with the support decision, including meeting targets for jobs, investment outlays and qualitative criteria.

Inspections by tax authorities and PSI supervisory institutions, including PAIH and SEZ managers, cover:

compliance with the rules,

monitoring progress and settlement of the investment,

audits, especially for large projects,

transfer pricing verification if the company operates within a corporate group.

Identified irregularities may result in repayment of the support together with interest. Therefore, monitor the investment as it proceeds, especially against qualitative criteria such as innovation, environmental performance and the number of new jobs.

Learn who may qualify for Poland’s Investment Zone, which investments and costs may be eligible, and how to apply for support.

[1579
1556,1549
1213

post-3945","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-corporate-law","tag-corporate-law","tag-taxes-en","specialization-corporate-law
["GET
