From July 8, 2026, Poland’s National Labour Inspectorate (Państwowa Inspekcja Pracy, or PIP) will be able to determine the existence of an employment relationship through an administrative decision, without first taking the case to a labor court. It changes how that definition can be enforced.

New powers of the labor inspectorate

The main changes are:

An administrative route to determining employment. A district labor inspector may issue a decision confirming the existence of an employment relationship under the new Article 11(1)(7a) of the Act on the National Labour Inspectorate. Previously, only a labor court had this power.

A wider inspection scope. PIP may inspect not only employers but also businesses and other entities for which individuals, including sole proprietors, perform work or have performed work within the past year. This follows the amended Article 13(1) of the Act on the National Labour Inspectorate.

Higher fines. The upper limit for a fine for replacing an employment contract with a civil-law contract rises from PLN 30,000 to PLN 60,000, and to PLN 90,000 in the most serious cases, under amendments to Articles 281-283 of the Labor Code.

A new retaliation offense. Unfavorable treatment of, or retaliation against, a person covered by a determination of an employment relationship may result in a fine of up to PLN 60,000.

Information sharing with ZUS. Under Article 14a of the Act on the National Labour Inspectorate, PIP provides ZUS with information established during inspections. After a PIP decision, ZUS may independently seek overdue contributions.

Individual interpretations. Businesses may seek the Chief Labour Inspector’s position on how a particular working arrangement should be classified.

The reform implements milestones A71G and A72G of Poland’s National Recovery Plan, concerning stronger labor-market oversight and reduced substitution of employment contracts with civil-law contracts.

How the procedure works

The process begins with an inspection, not an immediate administrative decision.

Inspection and instruction to remedy a violation. A field inspector examines how the parties work together. If the inspector identifies features of employment, they issue an instruction, for example, to enter into an employment contract. The inspector must hear both parties before issuing it. If the instruction is followed voluntarily, the process ends at this stage.

Application to the district labor inspector. If the instruction is not followed, the field inspector asks the district labor inspector to initiate administrative proceedings.

District labor inspector’s decision. The district labor inspector issues a decision confirming an employment relationship only where the evidence establishes it unequivocally and without doubt. In a disputed case, the district labor inspector should bring a claim before the labor court instead.

Appeal to a labor court. A party dissatisfied with the decision may appeal to a district court acting as a labor court. As a rule, an appeal stays enforcement of the decision until the court’s judgment becomes final.

Full judicial review. The labor court is not bound by PIP’s findings. It may uphold, amend, or set aside the decision. If the decision is set aside, the business is entitled to compensation from the State Treasury.

There is also an anti-avoidance provision. If a business terminates its civil-law contract with the individual during the inspection process, between the start of the inspection and the decision becoming final, the employment start date stated in the decision may be moved back to the date the inspection began.

Why rewriting a B2B contract is not enough

Adding an independence clause or changing the terminology in a contract does not resolve a mismatch between the document and reality. Article 22 §1¹ of the Labor Code states that work performed under the conditions of an employment relationship is employment regardless of what the parties call their contract.

The inspector therefore examines the actual arrangement, not just the agreement. A well-drafted B2B contract may coexist with fixed working hours, a supervisor issuing instructions, time records, and employee-style absence procedures.

What an inspector examines

PIP uses a typological assessment: it considers the combination and strength of relevant features rather than mechanically counting how many boxes are checked. There is no exhaustive statutory checklist.

Feature

Points toward employment

Points toward an independent B2B arrangement

Personal performance

The individual must do the work personally and cannot arrange a substitute.

The contractor may use subcontractors.

Direction and supervision

A supervisor gives instructions that the individual must follow.

The contractor organizes the work and makes independent decisions.

Place and time

The client sets the workplace and hours, such as 9 a.m. to 5 p.m. in an office.

The contractor sets these flexibly.

Business risk

The engaging business bears the risk.

The contractor bears business risk.

Organizational integration

The individual is part of the company hierarchy.

The contractor operates as an external business partner.

Equipment and tools

The individual uses a company laptop, VPN, and internal systems.

The contractor uses their own equipment.

Payment basis

Payment is based on hours worked and time records.

Payment is based on a deliverable, project, or result.

Payment and ongoing work can occur in both employment and B2B arrangements; neither decides the classification on its own.

Three practical scenarios

A law firm with 15 lawyers operating as sole proprietors. Each invoices only the firm, works from 9 a.m. to 5 p.m., has a supervisor, uses a ticketing system, and does not sell services directly to clients. Although the contracts describe independent businesses, the working model has classic employment features. Reclassification across 15 relationships could create liabilities measured in hundreds of thousands of zlotys.

An IT company with 30 B2B developers. They attend a daily 9 a.m. stand-up, log time in a project-management system, use company equipment, and agree “vacation” with a supervisor. Their daily work is indistinguishable from that of employees. Following a PIP inspection, restructuring costs could exceed PLN 1 million.

A genuinely independent contractor. A sole proprietor works on projects for multiple clients, organizes their own work, uses their own equipment, and is paid for results. On those facts, even an inspection would not provide grounds for reclassification.

Invoicing only one client is an important warning sign. The article treats exclusivity as a strong indicator of employment, even where other parts of the arrangement appear appropriate. It is not, however, automatically decisive: the inspector considers it alongside the other circumstances.

What reclassification may cost

A PIP decision operates prospectively from the date it is issued. That does not prevent separate claims concerning earlier periods.

Earlier-period liabilities

Overdue ZUS contributions. ZUS may seek contributions for up to five years retrospectively, subject to the limitation period. These may include pension, disability, health, accident, Labor Fund, and Guaranteed Employee Benefits Fund contributions. At IT-sector remuneration levels of PLN 15,000 to 30,000 net per month, overdue contributions for one individual may reach tens of thousands of zlotys.

Overdue personal income tax (PIT) advance payments. The employer, as tax remitter, is liable for tax it failed to withhold. Article 26a of Poland’s Tax Ordinance excludes the employee’s liability; the burden falls on the business.

Employee claims. A reclassified individual may claim payment for unused annual leave, overtime, night work, or severance. The limitation period for employment-related claims is three years.

Current obligations and disruption

From the date of the decision, employment brings obligations relating to annual leave, working-time records, medical examinations, occupational health and safety training, and protection against dismissal. An abrupt change may also disrupt projects, increase payroll costs, and require team restructuring.

Potential penalties and other consequences

Issue

Legal basis stated in the approved article

Potential consequence

Replacing an employment contract with a civil-law contract

Article 281 of the Labor Code, as amended

Fine of up to PLN 60,000; A district labor inspector will be able to determine independently that an employment relationship exists, without taking the case to court. Fines have increased to PLN 60,000 to PLN 90,000. ZUS may pursue overdue contributions for up to five years. Updating contracts alone will not be enough. Risk depends on the day-to-day working arrangement: hours, supervision, equipment, and whether the contractor invoices only your company. Addressing these factors early can reduce the risk when the provisions take effect.

If you are unsure whether your model is safe, arrange a diagnostic consultation. A short review can verify that the contracts and actual practices match; an inspector will assess all the circumstances, not just the company’s understanding of them.

Will updating our B2B agreements protect us during a PIP inspection?

No. Article 22 §1¹ of the Labor Code makes the contract’s name irrelevant where work is performed under the conditions of employment. Review and, where necessary, change the daily working model before revising the agreements to reflect it.

A sole proprietor invoices only our company. Does that automatically make them an employee?

No. Exclusive invoicing is a strong indicator, not an automatic answer. The inspector will also examine fixed hours, supervision, equipment, personal performance, and other features. The risk rises when exclusivity is combined with subordination.

What could reclassifying one B2B contractor cost?

It depends on remuneration and the length of the relationship. At the IT remuneration levels cited above, PLN 15,000 to 30,000 net per month, up to five years of overdue ZUS contributions could amount to tens of thousands of zlotys per person. Potential additional costs include claims for unused leave within the applicable three-year period, overtime, severance, and overdue PIT advance payments. Across a dozen or more relationships, exposure may reach hundreds of thousands of zlotys.

Are freelancers with multiple clients covered by the new rules?

The inspection powers can apply, but freelancers who serve multiple clients, organize their own work, and are paid for results are among the lower-risk arrangements described here. The principal concern is B2B work used in place of employment, for example, where one client sets fixed hours, supervises the individual, and provides equipment.

Does PIP use a fixed checklist?

No. The inspector assesses the overall configuration and strength of the features: direction and supervision, personal performance, control over time and place, business risk, payment method, and integration into the company. No single question replaces an assessment of the full relationship.

The PIP reform makes it more important to address working practices before an inspection, rather than relying on contract labels.
